La experta en Derecho Mercantil Cecilia Franco ha asegurado que en Espa\u00f1a \u00abno tenemos una cultura del fracaso y de volver a empezar\u00bb y por eso cree que es \u00abfundamental\u00bb que se d\u00e9 a conocer la funci\u00f3n que cumple el Derecho Concursal y Mercantil, junto con la Ley de Segunda Oportunidad, con el objetivo de las empresas que hayan ca\u00eddo en situaciones complicadas \u00abvuelvan a empezar\u00bb.<\/p>\n

As\u00ed lo ha manifestado Franco en una entrevista concedida a Europa Press en el marco de los Cursos de Verano que la Universidad Pablo de Olavide (UPO) est\u00e1 celebrando en su sede de Carmona (Sevilla), donde dirige la s\u00e9ptima edici\u00f3n del curso ‘La implantaci\u00f3n de los cambios en el TLC y cuestiones mercantiles relacionadas’.<\/p>\n

Seg\u00fan ha explicado la abogada, el Derecho Concursal es una rama dentro del Derecho Mercantil encargado de regular las relaciones de las empresas, de las sociedades, de las personas jur\u00eddicas y de cualquier profesional. \u00abEste ampara a las empresas que se ven afectadas por situaciones de sobre endeudamiento y de impago\u00bb, ha detallado para a\u00f1adir que el motivo m\u00e1s frecuente por el que las empresas caen en este estado es \u00abel no tener capacidades para saber hasta donde pueden llegar invirtiendo en un negocio\u00bb.<\/p>\n

Cuando se dan situaciones de sobre endeudamiento, Franco ha abogado por que el derecho \u00abaplique la Ley de Segunda Oportunidad\u00bb y dar as\u00ed \u00abuna nueva oportunidad\u00bb a aquellas personas que quieren empezar de nuevo\u00bb. Para ello, la experta ha a\u00f1adido que se puede llegar a diferentes acuerdos como \u00abla entrega de bienes\u00bb \u00abun concurso en masa\u00bb o incluso haciendo \u00abun plan de pagos llegando a un acuerdo con los acreedores\u00bb.<\/p>\n

Franco ha manifestado que el derecho protege a las personas f\u00edsicas en su totalidad. En este tipo de situaciones, ha detallado que \u00fanicamente hay que \u00abpagar parcialmente deuda p\u00fablica, en el caso de tenerla\u00bb y ha asegurado que, gracias a esta ley, \u00ablas empresas tienen la posibilidad de empezar realmente\u00bb<\/p>\n

Por \u00faltimo, ha concluido diciendo que actualmente, debido a la situaci\u00f3n de inflaci\u00f3n actual con la guerra de Ucrania, \u00ablas empresas se ver\u00e1n afectadas a lo largo del tiempo\u00bb vaticinando que \u00abno es una cosa inmediata, pero s\u00ed se van a ver perjudicadas a largo plazo\u00bb.<\/p>\n
