LA CHARTE SOCIALE EUROPEENNE ET SON APPLICATION PAR LES JURIDICTIONS INTERNES : REGARDS CROISES ENTRE LA JURISPRUDENCE FRANÇAISE ET ESPAGNOLE

Resumen

La Charte sociale européenne (CSE) est un instrument remarquable de protection des droits sociaux. Depuis la mise en œuvre des plans d’austérité, une plus grande importance lui a été conférée dans le contexte juridique et social européen, grâce aux décisions rendues par le Comité européen des droits sociaux (CEDS) dans lesquelles ont été constatées de graves violations à la CSE par certains États membres. À cet égard, l’analyse comparée des jurisprudences espagnole et française sur l’application directe de la CSE par les juridictions nationales nous semble être un exercice important pour réaffirmer le caractère essentiel de cette Charte, notamment en vue de la construction d’une Europe plus sociale.

The European Social Charter (ESC) is a remarkable instrument for the protection of social rights. Since the implementation of the austerity plans, greater importance was conferred to it in the European legal and social context, due to the decisions rendered by the European Committee of Social Rights (ECSR) which found serious violations of the ESC by some Member States. In this regard, the comparative analysis of Spanish and French legal precedents on the direct application of the ESC by national courts seems to be an important exercise to reaffirm the essential character of the ESC, especially in view of the construction of a more social Europe.
