Artificial Intelligence, Normative Power and the Common Good in the European Union

Abstract

This article examines the current and consolidating EU regulatory framework on artificial intelligence (AI) as a vector of normative power in the European Union that directly affects public authority, fundamental rights, and the configuration of the common good. Starting from the premise that AI is not a neutral tool but an infrastructure with constitutional effects, it argues that regulation cannot be confined to a technical or risk-management logic but requires a constitutional and humanist foundation. The article analyses the EU regulatory framework, particularly the Artificial Intelligence Act, and contends that material limits to automated decision-making derive from the centrality of the human person and the requirements of the common good. It finally proposes a humanist reconstruction of algorithmic governance aimed at preserving an irreducible core of human decision-making and strengthening democratic accountability.
