The vicissitudes of the human right to peace. Report of an unfinished codification process

Abstract

In this article we review the conversion of peace into a human rights category over the last decades considering three perspectives: 1) the two-track codification process in which the participation of civil society organisations and non-state actors’ initiatives were prominent, 2) the status of the right to peace within third-generation human rights and in relation to the conception of positive peace, and 3) some political implications derived from demanding the accountability of states and the promotion of social justice at the global level. We conclude that the ultimate outcome of this juridification process to date, the Declaration on the Right to Peace, is probably an interim achievement in a larger collective learning process.

David Sánchez Piñeiro, University of Oviedo, Spain

Graduado en Filosofía por la Universidad de Oviedo, MA in Political Philosophy por la Universitat Pompeu Fabra de Barcelona y Doctorando en el Programa de Investigaciones Humanísticas por la Universidad de Oviedo. Actualmente disfruta de un contrato predoctoral Severo Ochoa en el Departamento de Filosofía de la Universidad de Oviedo, Programa financiado por la Consejería de Educación y Ciencia del Gobierno del Principado de Asturias, con duración hasta 2025.

Su tesis se centra en las teorías de la democracia radical de Cornelius Castoriadis y Ernesto Laclau. También ha estudiado y publicado sobre autoras como Nadia Urbinati y Chantal Mouffe. Ha publicado en volúmenes colectivos y en revistas nacionales e internacionales, así como en medios de comunicación.
